The crime of harassment is any kind of behavior that is unwanted and is intended to annoy, disturb, alarm, torment, upset or terrorize an individual or group. Cyberstalking Cyberstalking is the use of electronic technology such as computers, cell phones and tablets that can access the internet and send emails to repeatedly stalk or threaten physical harm to a person or group. This can include posting threats on social web pages, chat rooms, website bulletin boards, through instant messaging and through emails. Example of Cyberstalking In January 2009, Shawn D. Memarian, 29, of Kansas City, Missouri pleaded guilty to cyberstalking by using the Internet - including e-mails and website postings - to cause substantial emotional distress and fear of death or serious bodily injury. His victim was a woman he met online and dated for about four weeks. Memarian also posed as the victim and posted fake personal ads on social media sites and in the profile described her as sex freak looking for sexual encounters. The posts included her phone number and home address. As a  result, she received numerous phone calls from men answering the ad and around 30 men showed up at her home, often late at night.He was sentenced to 24 months in prison and 3 years of supervised release, and ordered to pay $3,550 in restitution. Cyberharassment Cyberharassment is similar to cyberstalking, but it does not involve any physical threat  but uses the same methods to harass, humiliate, slander, control or torment a person. Example of Cyberharassment In 2004, 38-year-old James Robert Murphy of South Carolina was sentenced to $12,000 in restitution, 5 years probation and 500 hours of community service in the first federal prosecution of cyberharassment. Murphy was guilty of harassing an ex-girlfriend by sending multiple threatening emails and fax messages to her and to her co-workers. He then began sending pornography to her co-workers and made it appear as if she was sending it. Cyberbullying Cyberbullying is when the internet or interactive electronic technology such as mobile phones is used to harass, insult, embarrass, humiliate, torment or threaten another person. This can include posting embarrassing pictures and videos, sending insulting and threatening text messages, making derogatory public remarks on social media sites, name-calling, and other offensive behavior. Cyberbullying usually refers to minors bullying other minors. Example of Cyberbullying In June 2015 Colorado passed the Kiana Arellano Law that addresses cyberbullying. Under the law cyberbullying is considered harassment which is a misdemeanor and punishable by fines up to $750 and six months in jail. The law was named after 14-year-old Kiana Arellano who was Douglas County high school cheerleader and who was being bullied online with anonymous hateful text messages stating that no one at her school liked her, that she needed to die and offering to help, and other vulgar demeaning messages. Kiana, like many young teenagers, dealt with depression. One day the depression mixed with the non-stop cyberbullying was too much for her to cope with an attempted suicide by hanging herself in the garage of her home. Her father found her, applied CPR until the medical team arrived, but due to the lack of oxygen to Kianas brain, she suffered severe brain damage. Today she is paraplegic and unable to talk. According to the National Conference of State Legislatures, 49 states have enacted legislation aimed at protecting students from cyberbullying. Example of State Harassment Statues In Alaska, a person can be charged with harassment if they: Insult, taunt, or challenge another person in a manner likely to provoke an immediate violent response;​Telephone another and fail to terminate the connection with intent to impair the ability of that person to place or receive telephone calls;​Make repeated telephone calls at extremely inconvenient hours;​Make an anonymous or obscene telephone call, an obscene electronic communication, or a telephone call or electronic communication that threatens physical injury or sexual contact;​Subject another person to offensive physical contact;​Publish or distribute electronic or printed photographs, pictures, or films that show the genitals, anus, or female breast of the other person or show that the person engaged in a sexual act; orRepeatedly send or publish an electronic communication that insults, taunts, challenges, or intimidates a person under 18 years of age in a manner that places the person in reasonable fear of physical injury. Parents and the general society are pushing this generation to becoming mini-adults that seem mature, but is not yet developed enough to actually be mature. As a result, the children become frustrated and stressed, leading to the development of disabilities and disorders. Parents and society needs to not only become aware of, but to also take charge of the mental condition of the next generation. Commerce Bank Case free essay sample

Commerce bank has been a pioneer in the banking industry by reverting to customer service. This has driven customers to the bank, but in order to stay ahead on the curve they want to move away from the model that has worked for them. They should focus on the current model and enhance it, rather than change it. Background Commerce bank also known as Commerce Bancorp is a New Jersey based bank founded in 1973 by fast food restaurant franchiser Vernon Hill. Hill took his experience as a fast food business owner and used it to operate Commerce bank. The world†, he reasoned, â€Å"did not need another ’me-too’ bank† (Frei, 2006, p. 4. ) Hill created a retail franchise with branches openening earlier than the competitors and staying open later than the competitors, 7:30AM to 8:00PM during the week and modified hours on Saturday and even Sunday (Frei, 2006, p. 4). Drive through windows at some busier locations even stayed open till midnight to accommodate customers, however all branches operated un the notian that they were to open 10 minutes before and close ten minutes after the posted time, calling it the â€Å"ten-minute rule† (Frei, 2006, p. 4. ). Commerce used this model to get customers in the door and made their primary focus customer service. This focus allowed them to increase customer deposits, by an average of 30% per year from 1996 to 2001, some years they even achieved growth rates in excess of 40%. This was not consistent with the market trend during this period. Other banks where opting for internet banking, literally pushing customers out the door. Hill felt that this was a model for failure, because â€Å"You can’t name one retailer in this country that has pushed people where they don’t want to go and succeeded† (Frei, 2006, p. . ). Currently Commerce is feeling the pressure from other banks, who wants to use their business model to draw new customers. Washington Mutual for instance launched â€Å"un-bank†, with roaming tellers, a children’s play area and no desk. ING a new entrant in the market opened a cafe style branch that served espresso to customers at seated tables (Frei, 2006, p. 11). To combat this Commerce launched a new customer experience called â€Å"Retailtainment†. Retailtainment is the incorporation of entertainment into the various branches. Essentially each branch can come up with their own wacky ideas for entertaining customers every Friday (Frei, 2006, p. 11). This was to ensure that Commerce, who offer lower rates, stay ahead of the competition. Problem Statement Commerce bank is losing track of what the sole purpose of banking is and what the customers really want in a banking experience. Analysis â€Å"Many banks attribute their growth to their successful transformation to a sales culture† (http://www. bankrate. com/brm/news/bank/20051024a1. asp) . Commerce has used old school banking to carve out a niche in the banking industry. When you look at other banks, you’ll notice that they are moving towards internet banking, focusing less on the person to person interaction. This could have catastrophic implications, â€Å"I am referring to the turn-off of poorly trained, new employees. Whats worse is seeing this person struggle and look in vain for help from someone else in the branch† (http://www. bankrate. com/brm/news/bank/20051024a1. asp) Commerce on the other hand have embraced this by training employees in the art of customer service. At the Commerce bank University, new employees undergo intense introduction to Commerce’s culture, and traditions. The class is actually called â€Å"Traditions†, were employees are taught to smile, shake hands and greet customer (Frei, 2006, p. 9. ). This training leads to good service, and this framework is called â€Å"WOW†. WOW is a program that was developed in 1994 to teach employees service. To drive this program even more, employees are awarded when they â€Å"WOW† customers, by getting little red C’s for every instance. These C’s can then be turned in for merchandise. On Friday’s Commerce bank would have a â€Å"WOW† patrol visted branches to take pictures with employees and customers who were wearing red. One author in the New York Times is quoted as saying â€Å"The locations also feature colorful change-counting machines and upbeat employees, who every Friday are decked out in red, often to hilarious effect† (http://www. nytimes. com/2006/02/26/business/yourmoney/26mgmt. html? _r=1pagewanted=all) . This contributed to the customers overall experience, and was used to great effect to bring traffic in the door. The customer central model, was the springboard for what Commerce believed was the â€Å"value of the bank†, customer deposits (Frei, 2006, p. 5. Hill believed that by focusing on â€Å"non-rate† reason deposits, that he could build a deposit base. â€Å"Banks had given up on growing all together because theu thought you had to pay the highest deposit rate to get growth† (Frei, 2006, p. 5. ). Hills’s philosophy was just the opposite, the bank provided customers with an unforgettable experience in exchange for a deposit rate, half a point less than the competition. This lower rate enables Commerce to stay open later and have more additional benefits for its members. These benefits include no fee banking and even ATM fee refunds to high balance members. To ensure this experience was the same for all the members of the bank, Commerce standardized it’s branches, down to the nuts and bolts, â€Å"We know every screw in the modelâ€Å"(Frei, 2006, p. 7. ), this Cunningham the chief marketing officer, felt would make life easier for customers. At these branches are all greeted at the front door by greeters and made to feel at home and offered treats while they wait to be served. This is unique from other banks who sometimes charges fees for customers if they visit the branches or talked to a real person. â€Å"Customers enrolled in Bank of Americas e-banking account pay $8. 5 a month for the privilege of accessing branches and talking to tellers when you need to make a transaction or deposit†( http://money. cnn. com/galleries/2011/pf/1106/gallery. annoying_fees/4. html) Commerce bank was certainly the winner on the ground, but they felt threaten by some competitors who copied there models in the New York area, namely ING and Washington Mutual. In fear of losing it’s hold on the ground, Commerce implemented a decentralized program called â€Å"Retailtainment†. This program would allow branches to come up with their own ideas, even wacky ideas, to entertain members on Fridays. For starters this is a break from the model that has worked so far and that is standardization. Commerce had built the brand name using this philosophy, and moving away from this will hand the control over to the branch. With the bank industry ratings on the decline this strategy may back fire severely and hurt the brand down the road. â€Å"In October 2010, the number of Americans expressing a great deal or quite a lot of confidence in banks fell to an all-time low of 18% lower than its level at the height of the global financial collapse. Gallup analysts find this to be a continuation of a free fall that began in 2006† (http://businessjournal. gallup. com/content/148049/rebuilding-trust-banks. aspx) This strategy may or may not work, but it is not the real issue at hand. Consumer enter the bank, much as they do a fast food restaurant, Hills background, with speed of service in mind. Commerce bank have all the greeters and all the friendly smiles, but customers have been complaining about the lack of tellers and feels that the bank should have less greeters and more tellers. (Frei, 2006, p. 1) Recommendations and Conclusions â€Å"Retailtainment†, may sound like a good idea, but it has plenty of issues associated with it. Commerce bank uses a standardized process and this will steer them away from that model. They will decentralize a process and they will rely on the managers to make their own decisions. By relying solely on the managers and their staff, Commerce runs the risk of harming their image. There are other ways that they can look into to increase business. They need to look no further than the greeters within the branches. Commerce has focused so much on the first impression that they lost sight of what people are there for. People are there to deposit their money, and undue delays in the process within the branch may lead to less than satisfactory service. Commerce can take some of the greeters and make them â€Å"junior† or â€Å"overflow† tellers. They can create a middle level of greeters/tellers that makes less than tellers, but more than greeters. This group can be seen as back-up to jump into action when there is heavy flow of traffic in the bank. They can also use these junior tellers to accept check deposits at the front, so customers don’t have to stand in line. . Conclusion Customers don’t care about a free hotdog in a bank, they care about service and the speed in which they can receive the service. Commerce needs to focus on the model that works and refrain from venturing into untested waters, they may lead to problems.

Doing Good Doing Good Doing Good By Maeve Maddox A reader has asked me to comment on the following sentences: Didnt they do good. The boy did good. The word good has numerous definitions and nuances. I started to count all those listed in the OED entry, but gave up, there were so many. The chief use of good is as an adjective: Read any good books lately? It is also frequently used as a noun: Political leaders should consider the common good. A few special constructions exist in which good is used adverbially: He as good as told me he was quitting. Besides being ungrammatical, using good to modify a verb creates ambiguity. The sentences â€Å"Didn’t they do good† and â€Å"The boy did good† suggest that â€Å"they† and â€Å"the boy† were occupied in doing good works. In one of my favorite scenes in the television show 30 Rock, Tracy Morgan asks someone â€Å"How are you doing?† When the other character responds Good. Im doing good! Tracy fixes him with a disapproving stare and says Superman does good. You’re doing well. If â€Å"they† and â€Å"the boy† are not â€Å"doing good† in the sense that Superman and Habitat for Humanity do good, then the good is being used incorrectly. One way to improve these sentences is to replace the adjective good with the adverb well: Didn’t they do well? The boy did well. If this use of â€Å"well† sounds too stuffy for conversation, then the sentences could be rendered as Didn’t they do a good job? The boy did a good job. As language descriptivists would tell us, good is often used as an adverb in conversation. This is true. I use it myself at times, in fun, or to convey praise without seeming sentimental. Ex. You done good, Son! Nevertheless, speakers and writers aiming at standard usage acceptable to a wide audience do well to avoid this construction. Porters Five Forces of Competition Essay Porter’s Lesson: Michael E. Porter’s article, the five competitive forces that shape strategy, is an article that dissects the true underlying factors of competition and industrial structure. Throughout the context of the article, Porter thoroughly explains how competition and profitability does not only derive from production of goods and services or the level of sophistication of a firm. Instead, he claims that in order for an industry to be truly competitive and profitable, the industry as a whole must hold a solid structure. Porter educates the audience by introducing the five key forces of strategy that will essentially lead to a firm’s prevalence of competitiveness. He labels these forces as direct competition, customers, suppliers, potential entrants, and substitute products. Porter claims that each of these forces of competition plays their roles within any competitive and even temporarily non-competitive industry. Porter’s main lesson for his audience is that in order for an individual firm or an industry to succeed, it must strategically know how to react to any shift within the industry, whether its competitiveness, supply and demand, economical issues, potential entrants, or even natural issues. Porter also strives to explain how a company could or could not earn a return on investment based on the intensity of the competition within the industry. All in all, Porter explicitly explains each of the five forces that shape an industries competition with a breakdown of different factors for each force, as well as real life examples that make the topic very clear for the audience to understand his lesson. Analysis of the Lesson: Of the five forces, Porter clearly educated the reader about the importance of potential entrants and their threat to an industry. I felt that one of Porter’s greater lessons in this matter was when he described the seven major sources of entry barriers, and how an incumbent can strategize to react to the competitiveness of the industry if a desired entrant were to exist. One aspect that really sparked my interest was when Porter went about explaining the entrant’s hesitancy of entering into an industry based on the level of retaliation from the existing firms within the market. On the other hand, it was also interesting to know that the entrant could also alarm the incumbents, when the entrant has a large amount of capital to invest as they enter from another market which they succeeded in. Another force that Porter dissected is what most people would think of in reaction to the term competition, and that is direct competition of one firm and another, or for the lack of a better word, rivalry. Porter made a statement, and that was, â€Å"The degree to which rivalry drives down an industry’s profit potential depends, first, on the intensity with which companies compete and, second, on the basis on which they compete.† As Porter discussed the different factors that affect the intensity of a rivalry, he noted that intense rivalry tends to destruct profitability if the battle between two firms is focusing solely on price because at that point, price competition is simply transferring profits directly from an industry to its customers, which will ultimately result in the degradation of an industry. I couldn’t agree more with Porter about the fact that when it comes to rivalry between multiple firms, the industry can find an advantage when each competitor aims to serve the needs of different customer segments, by focusing on a variety of price, products, services, features, or brand identities. Most people would think of a rivalry in terms of competition, and not necessarily take the time to think of other factors that are just as important when it comes to an industry’s competitiveness. Many are so focused on what goes on within their own market that they forget to acknowledge the outside forces until it slaps a firm across the face. Porter used an example of the photographic industry as he explained the importance of substitute products. Here he argued that long time competitors such as Kodak Fuji, two large photographic film companies, were in a position to lose profitability if they didn’t focus on outside forces, such as the entry of digital cameras. Although they are not as profitable as before, both companies made large investments, along with large amounts of research and development, and both prevailed in continuing to be somewhat profitable and slightly competitive in their industry rather than falling off all together. After reading that example, I instantly thought of different firms that didn’t focus on innovating at times where substitute products came into play, and those companies are no longer around. A few examples of companies that fell or are bound to fall are Blockbuster, Circuit City, Best Buy, K-Mart, and Sears. Once Porter ended his presentation of the five forces of competition and profitability, he continued to approach his final lesson, and that is the value created if a strategist accurately analyzes the five forces of competition within an industry. He enlightened the audience that if a strategist understands the competition within the industry, he will not only prevail beyond existing rivals, but could also uncover new opportunities such as differences in customers, suppliers, substitutes, potential entrants, and rivals that can become the basis for distinct strategies leading to superior performance. The only minor detail I felt that should have been added to this section on value is the possibility of losing value based on time devoted towards each force. Porter most definitely stated the facts when explaining the potential for new opportunities if understanding the industry as a whole. One thing he didn’t explain is what could also happen if a strategist possibly focuses on one aspect for too long, or fails to devote enough time to one competitive force versus another. I would imagine that this could possibly cause problems to arise rather than opportunity if a firm were to not manage its strategic time wisely. My Takeaways: I am fortunate that I am currently involved in a family business that allows me to relate to so many aspects of this article. My family currently owns and operates a five-store, soon to be six, supermarket chain in several parts of southern California. Like many other businesses, the everyday operation of a supermarket is exposed to countless aspects of business and its overall environment. I myself am within the world of supermarkets six out of the seven days in the week, and I can most definitely admit that this article completely enhanced my understanding of the terms competition and profitability. The amount of connections I could make with topics in this article to my everyday work is countless. For this paper, I’ll simply discuss what stood out most. First, I’ll have to give my takeaway on price competition and bargaining power. Item prices throughout the stores are what I’d consider to be the bullets in a gunfight between two competing supermarkets. There was a topic I discussed in my analysis that stated, â€Å"Firms that solely focus on price competition ultimately gives industry profitability to the customer.† In the supermarket industry, buyers constantly negotiate with suppliers for the lowest costs to provide customers with the most aggressive prices. This also relates to the section on buying power that Porter touches on. Here I learned, any store can simply raise prices or drop prices at store level, but the company that will prevail is that who is dominant in getting the lowest cost from the supplier, resulting in more aggressive margins verse the competitor. If both you and your competitor have the same price on one item, allow the competitor to give its profit to the customers by you being the one to pay less for the supply. The second factor that I can relate to which I will discuss is threat of new entrants and retaliation. If someone pulls up a map of supermarkets in a specific area, they will find seven to ten different supermarkets in a five mile radius. Competition from one company to another usually occurs within each region. At times, successful independent supermarket chains will raise awareness of other supermarket chains in a specific region by preparing to open a new store or buying out a current store that is not profitable. This is when the incumbents will do everything in their power to keep their customers from going to the new store that is most likely going to enter with highly aggressive pricing. At this time, you will see incumbent’s prices dropping, promotions increasing, advertisements become incredibly aggressive, prizes being given out, and any other form of retaliation a company can perform to keep its market share. As stated before, the connections are countless, and I could truthfully admit that I could write a twenty page paper on all the topics I can relate to in this article.
